    Agreement to Terms

    These Terms of Service ("Terms") constitute a legally binding agreement between you and Autism & Brain Institute, LLC ("ABI," "we," "us," or "our"), governing your use of our website, online portals, and clinical services. By accessing our website or receiving services, you agree to be bound by these Terms.

    Services Provided

    Autism & Brain Institute provides pediatric speech-language pathology and occupational therapy services at our clinics in Reno and Las Vegas, Nevada. Our services include but are not limited to:

    • Speech and language therapy evaluations and treatment
    • Occupational therapy evaluations and treatment
    • Autism and AAC (Augmentative and Alternative Communication) support
    • Parent coaching and caregiver training
    • Brain-based therapeutic interventions
    • Telehealth services (where appropriate and legally permitted)

    Appointments and Cancellations

    Scheduling

    Appointments may be scheduled by phone, through our parent portal, or in person. We will confirm your appointment time and provide any necessary preparation instructions.

    Cancellation Policy

    We understand that circumstances arise that may require you to cancel or reschedule appointments. To ensure availability for all patients:

    • 24-Hour Notice Required: Please provide at least 24 hours' notice for cancellations or rescheduling
    • Late Cancellation Fee: Cancellations with less than 24 hours' notice may be subject to a fee
    • No-Show Policy: Patients who miss appointments without notice may be subject to fees and/or dismissal from services after repeated occurrences
    • Late Arrivals: If you arrive late, your session may be shortened to accommodate subsequent appointments

    Attendance Expectations

    Consistent attendance is essential for therapeutic progress. Excessive cancellations or no-shows may result in discharge from services to allow other patients access to care.

    Payment Terms

    Insurance

    We accept various insurance plans. You are responsible for:

    • Providing current and accurate insurance information
    • Understanding your insurance benefits and coverage
    • Paying applicable copays, coinsurance, and deductibles at the time of service
    • Any charges not covered by your insurance plan

    Private Pay

    For patients without insurance or choosing to pay privately, payment is due at the time of service. We will provide you with our current fee schedule upon request.

    Outstanding Balances

    Accounts with outstanding balances may be subject to:

    • Suspension of services until payment arrangements are made
    • Collection activities for significantly past-due accounts
    • Reporting to credit bureaus in accordance with applicable law

    Consent for Treatment

    By receiving services, you consent to evaluation and treatment by our licensed therapists. For minor patients:

    • A parent or legal guardian must provide consent for evaluation and treatment
    • The consenting adult should be available during sessions or reachable by phone
    • Changes in custody or guardianship must be communicated to us promptly with supporting documentation

    Website Use

    By using our website, you agree to:

    • Provide accurate information when using contact forms or patient portals
    • Keep your login credentials confidential
    • Not attempt to gain unauthorized access to any portion of the website or connected systems
    • Not use the website for any unlawful purpose
    • Not reproduce, distribute, or create derivative works from our content without permission

    Parent and Employee Portals

    Access to our secure portals is subject to the following terms:

    • You are responsible for maintaining the confidentiality of your login credentials
    • You must notify us immediately of any unauthorized use of your account
    • Portal access is for authorized purposes only
    • We may suspend or terminate access for violation of these Terms
    • Information accessed through portals is confidential and subject to our Privacy Policy and HIPAA Notice

    Disclaimer of Medical Advice

    The information provided on our website is for general informational purposes only and is not intended as medical advice, diagnosis, or treatment.     Intellectual Property

    Limitation of Liability

    To the fullest extent permitted by Nevada law:

    • ABI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services
    • Our total liability shall not exceed the amount you paid for services in the twelve months preceding the claim
    • We do not guarantee specific therapeutic outcomes, as results vary based on individual circumstances

    These limitations do not apply to liability that cannot be excluded under Nevada law, including liability for gross negligence or willful misconduct.

    Indemnification

    You agree to indemnify and hold harmless Autism & Brain Institute, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of our services.

    Governing Law and Dispute Resolution

    These Terms are governed by the laws of the State of Nevada without regard to conflict of law principles. Any disputes arising from these Terms or our services shall be:

    • First addressed through good-faith negotiation between the parties
    • If unresolved, submitted to mediation in Clark County or Washoe County, Nevada
    • If mediation is unsuccessful, resolved through binding arbitration or litigation in Nevada state courts

    Termination of Services

    Either party may terminate the therapeutic relationship:

    • By Patient/Family: You may discontinue services at any time by providing written or verbal notice
    • By ABI: We may discharge patients for reasons including but not limited to:
      • Achievement of therapeutic goals
      • Lack of progress or appropriateness for our services
      • Excessive cancellations or no-shows
      • Non-payment of fees
      • Behavior that threatens the safety of staff or other patients
      • Violation of these Terms

    In cases of termination by ABI, we will provide reasonable notice and referrals to alternative providers when possible, except in cases of immediate safety concerns.

    Severability

    If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

    Changes to Terms

    We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified Terms.
